Sarath Fonseka begins fast

General Sarath Fonseka has begun a fast on to death to urge the authorities to allow him to talk to his children over the phone.

His wife, Mrs. Anoma Fonseka told reporters a short while ago that her husband had been denied the right to speak to his daughters who are currently overseas and therefore he would fast on to death till his demand was fulfilled.

General on hunger strike

Gen. Sarath Fonseka, who is being arbitrarily detained by the government, has started a hunger strike from today (07.03.2010) morning. He has commenced the hunger strike against the violation of fundamental rights that the Court has ensured to him.

Ms. Anoma Fonseka who visits General had been allowed to take a mobile phone. Gen. Fonseka talked to his children over this phone. However, yesterday this permission was withdrawn and his right to communicate with his children was denied to him. Gen. Fonseka commenced his hunger strike protesting against this arbitrary decision.

'Pillay Bell-e' repeats call for probe

UN High Commissioner for Human Rights Ms. Navi Pillay , today, once again repeated her call for an independent investigation into war crimes allegations in Sri Lanka stating that human rights abuses in the country were damaging prospects of reconciliation after 25 years of the civil war.

“I am convinced that Sri Lanka should undertake a full reckoning of the grave violations committed by all sides during the war, and that the international community can be helpful in this regard,” she said in a speech presenting her annual report at the UN Human Rights Council session in Geneva.

Last May, the council held a special session on Sri Lanka just after the end of the war against the LTTE, but the Sri Lankan government deflected criticism by introducing its own resolution praising its defeat of the Tigers, which was then passed, boosting the Colombo stock exchange.

President will appoint Court Martial

Former Judge Advocate Major General (retrd.) M. J. Samarakoon said today that a former military person can be court-martialled for treason, desertion and for fraudulently serving in the military at anytime even if they are no longer in service.

Mr. Samarakoon who served in court martial cases between 1981-1998 said if a very senior officer is being charged, there is provision in the Army Act to appoint junior officers to serve on the bench.

He said the bench would be appointed by the President and will comprise either three or a five member bench.

All evidence against SF out soon

The Army will produce all evidence against Gen. (retired) Sarath Fonseka within the next few weeks according to the army spokesman.

Major General Prasad Samarasinghe said that technical evidence is all that is left to be collected while evidence has already been recorded from 31 individuals regarding the case against the former General.

Cops arrested over molestation

Four policemen attached to the Mount Lavinia police crimes division have been arrested over allegations they molested a woman in Mount Lavinia last night while under the influence of liquor, the Mount Lavinia police told Daily Mirror online.

The policemen had molested the lady near the beach of a bar in Mount Lavinia last night while she was alone in the area. Relatives of the lady had later gone to the Mount Lavinia police station to vent their anger over the incident.

Following a complaint lodged at the police station the four police officers were arrested and produced before the Judicial Medical Officer (JMO) to see if their were under the influence of liquor. The lady who was molested is also to be produced to the JMO.

Army records more evidence

The Army has recorded evidence from 31 individuals regarding the case of General Sarath Fonseka (SF) who is presently in military custody, Major General Prasad Samarasinghe told Daily Mirror online. He added that the summary report was currently being prepared and that it will be presented to the Army Commander soon.

It was earlier reported that the former UNP MP Johnston Fernando and former MP Wijedasa Rajapaksa had also given evidence in a pre-inquiry trial against General Fonseka who was arrested by the Military Police while he was having a meeting with the politicians of the opposition parties on 8th of February.

Further the government recently declared that the General will also be tried under the civil penal code for his involvement in the with Hicorp dealings.

CID questions Hashan over Danuna

The Criminal Investigations Department (CID) recorded a statement today (03.03.2010) from former cricketer Hashan Tillekaratne over Danuna Tillekaratne, the son-in-law of General Sarath Fonseka.

Meanwhile Police Spokesman SP Prashanth Jayakody told Daily Mirror online that Tillekaratne's house was searched yeaterday (02.03.2010) after information had been received to the CID that Danuna Tillekaratne was hiding in his house.

The Police Spokesman added however that Danuna had not been at the premises of Hashan Tillekaratnes house and that the CID had only recorded a statement from Mr.Tillekaratne before leaving.

A warrant has been issued for the arrest of Danuna Tillekaratne in connection to the Hicorp case.

Cops interdicted over assault

Two police officers who were allegedly involved in an assault on a man at the Angulana police station this week have been interdicted over the incident. Another police officer has been exonerated over his involvement in the incident.

Residents of the area staged a protest in front of the police station on Monday alleging a youth who was taken in was assaulted while in custody. The youth was subsequently admitted to a hospital. A police constable of the Angulana police station had on Monday taken a youth into custody over his failure to produce the National Identity Card. In a subsequent altercation the police officers had allegedly assaulted the youth.

The OIC had released him on police bail. He had later got himself admitted to the Lunawa Hospital from where he had been transferred to Kalubowila hospital.

Moratuwa school principal arrested

A principal of a government school in Moratuwa was arrested today and is to be produced in court for assaulting five school children which resulted in two of them being hospitalized. It is an offence for teachers to physically assault school children.

No protest over protest [Video]

The British High Commission in Colombo has not lodged a complaint with the Sri Lankan government over a protest staged in front of the embassy this morning despite a well known government ally participating in the demonstration.

Foreign Ministry sources told Daily Mirror Online that they had not received any communication from the British High Commission or the party involved in staging the protest and therefore the government too would not respond or comment.

“This is purely a private protest and has nothing to do with the government. We have also not received any complaints,” a source at the Ministry said.

Foreign Minister Rohita Bogollagama also confirmed that he had not been informed of the protest and if any party lodged a complaint, then he would respond accordingly.

National Freedom Front (NFF) Leader Wimal Weerawansa participated in the protest in front of the High Commission this morning against British Foreign Secretary David Miliband attending the Global Tamil Forum in London last week. British Prime Minister Gordon Brown had also later met with the delegates of the Forum.

At the protest, large cut out’s of the British Prime Minister and Miliband were seen pasted across the walls with both of them dressed in LTTE outfits.

However when contacted and questioned if a complaint would be lodged against the protest and the large cut out’s portraying Miliband and Brown as LTTE cadres, Spokesperson at the British High Commission Dominic Williams said that Britain would not make an official comment.

The Sri Lankan government last week also protested vehemently stating that it was unethical of British senior government members attending such pro LTTE events and had also summoned the Acting British High Commissioner in Colombo over the issue.

UK will not make further responses regarding Miliband issue - British High Commission

Acting British High Commissioner in Sri Lanka Mark Gooding explained the rationale behind Foreign Secretary David Miliband’s participation at the Global Tamil Forum when he met the Lankan Foreign Minister last week, High Commission spokesman told Ada Derana. The spokesman added that the British Government will not be making any further responses regarding the matter.

Officials in London have also met the Lankan High Commissioner in UK and briefed him regarding the issue, British High Commission spokesman Dominic Williams added.

Sri Lankasummoned the Acting British High Commissioner on February 24 to lodge its “strong protest” against the UK Foreign Secretary David Miliband’s intention to participate at the Global Tamil Forum inaugural meeting.

Foreign Minister Rohitha Bogollagama who called a special briefing said that the Global Tamil Forum is an umbrella organization of the now vanquished terrorist group LTTE. He added that any Foreign Secretary’s physical presence at such a forum would give legitimacy to an organization with a separatist agenda for Sri Lanka.

Hicorp computer data record recovered

The Criminal Investigation Department has taken into custody certain data in a computer that was allegedly used to prepare documents for the Hicorp Company. These documents are said to have been in turn submitted to the Sri Lanka Army.

The CID recovered this information while carrying out a search of the residence of a director of the company from the Nugegoda area. He is presently in remand custody.

It is reported the CID probing the Hicorp deals has obtained permission from courts to question the Director in custody over these computer data. The Court has also issued an arrest warrant for Sarath Fonseka’s son-in-law Danuna Tilekaratne for grilling regarding the alleged financial irregularities that had been committed by the company. However, he is still absconding.

Colombo Magistrate today (26.02.2010) gave permission for the Terrorist Investigations Department to detain and question Rtd. Gen. Sarath Fonseka’s secretary Senaka De Silva, Brig. Duminda Kappetiwalana and four (04) others until March 26. The suspected denied the charges in court however according to the Emergency law the Magistrate allowed them to be detained further and questioned. They were arrested on charges of conspiracy to overthrown the government.

EXCLUSIVE : Military court looms over Fonseka

Twenty-five (25) people have come forward to give evidence against Rtd. Gen. Sarath Fonseka, Military Spokesman Maj. Gen. Prasad Samarasinghe told exclusively to Ada Derana. He added that collecting evidence for the case is almost over.

In an exclusive interview with Ada Derana Samarasinghe said that Fonseka has rejected the chance to cross examine the witnesses and a chance to provide witnesses to support his case.

Fonseka left active service on November 14, 2009 and thus he is under Military law until May 14, 2010, Samarasinghe said. He added that due to the nature of some of the charges against Fonseka it is necessary to take legal action within 06 months of the reported offence and hence it is likely he should be brought before a military court soon.

The civil court will proceed parallel to the military court however Fonseka has option of challenging the Military court decision at the Appeal Court and then go to the Supreme Court, Samarasinghe said.

He added that according the Military Act a maximum sentence of 20 years imprisonment could be given according to the severity of the offence. Samarasinghe also stated that though the death sentence does not have effect in Sri Lanka the Military court could hand down the death sentence.

Fonseka supporter released, TID finds no evidence

A supported of Rtd. Gen. Sarth Fonseka who was arrested for alleged conspiracy against the Government was released today (26.02.2010) by the Colombo Magistrate. The Terrorist Investigations Department who produced the suspect told courts that after extensive investigations they were unable to find evidence to charge him.

CID to consult AG on Hicorp investigations

The CID has decided to consult the Attorney General regarding all investigations on the Hicorp dealings. Accordingly all reports and documentation on the case will be handed over to the AG and his advice sought on how to proceed.

An arrest warrant was issued for Danuna Thilakaratne son-in-law of Rtd. Gen. Sarath Fonseka regarding the case and he is still absconding.
